LOVE AND JACKSON BOTH SELL 25% PUBLISHING STAKES 14/04/06
Courtney Love
is planning to sell 25% of her interest in the Nirvana song catalogue to Primary Wave Music Publishing . Love and Primary CEO Larry Mestel plan to work together to create more awareness and value for Nirvana's song catalogue, which includes hits such as Smells Like Teen Spirit, Come as You Are and Heart-Shaped Box. Love, who's the executor of Kurt Cobain's estate, previously battled surviving Nirvana band members Krist Novoselic and Dave Grohl before allowing the release of the Nirvana greatest-hits LP in 2002. Primary Wave Publishing is estimated to have paid more than $50 million for its percentage of the (Kurt Cobain) Nirvana rights, which is greater than Novoselic and Grohl's shares combined. "I am confident that between the genius of Kurt's music, Courtney's own creativity, and our years of experience in the music business, we can achieve something quite remarkable with these copyrights," Mestel said. So far there are no announced plans to use Nirvana songs in any movies, TV shows or ad campaigns. And rumours abound that Michael Jackson will avoid bankruptcy if he provides Sony - co-owners of the Sony/ATV Music catalogue with him - with an option to buy half his stake, or about 25 percent of the whole catalogue for an undisclosed buyout price. The entire Sony/ATV catalogue is valued at $1 billion. Jackson purchased 251 Beatles songs as part of ATV Music in 1985 for $47.5 million and fell out with Sir Paul McCartney over the deal. Sir Paul is still said to resent having to pay to play his own songs when on tour.  The catalogue includes 4,000 other songs including Sweet Caroline and Blowin In The Wind. It is believed that the new deal will release up to $200 million in cash to Jackson and will allow him to use his Mijac catalogue of his own songs as security/collateral against new loans of up to $300 million. This means  Jackson can avoid bankruptcy and can keep his ranch Neverland open.

GOTHS PRONE TO SELF HARM AND SUICIDE 14/04/06
They dress like vampires, look miserable and only come out at night wearing faded black Marilyn Manson and Sisters of Mercy T-shirts under leather trench coats but a real dark side to the goth sub culture has been shown in research by the University of Glasgow. The report, in the British Medical Journal, shows that goth identification was the single strongest predictor for youth self harm and attempted suicide. The Glasgow team analysed 1,258 young people when they were 11, 13, 15 and 19 years old and identified fourteen youth sub-cultures when looking at self harm, depression, attempted suicide and various other psychiatric disorders. Goths were the highest risk group although equally those with a tendency to self harm may be attracted to the goth group.  Research leader Robert Young also pointed out in the Times (14/04/06) that the goth culture could also give social and emotional support to young people to help them cope with difficulties they face.

HERITAGE ACTS TO GET LEGAL PROTECTION IN US? 08/04/06
Heritage bands from the 50s and 60s came closer to gaining legal protection against impersonators in one US state with the passage of a bill in the Connecticut state House of Representatives. The Senate is expected to vote on the legislation before the session ends in early May. House Majority Leader Christopher G. Donovan, held a press conference with former Sha Na Na lead singer Jon “Bowzer” Bauman in February to introduce the legislation, speaking out against musical acts that impersonate the bands of the 'Golden Oldies' era. Donovan encouraged his colleagues to vote for the measure, which he said would protect both bands and consumers. The bill will allow the Attorney General to stop a performance by an imposter band with an injunction and seek civil penalties up to $15,000 against the bands and those who advertise their performances. At the February press conference, Bauman said he felt the imposter groups hurt the real artists by performing for lower ticket prices and misrepresenting themselves to fans.

IFPI ANNOUNCE NEW WAVE OF LEGAL ACTIONS 05/04/06
Illegal music file-sharers across the world face a fresh wave of legal actions today as the recording industry announces an escalation of its campaign against digital music piracy.  The latest actions come with a new warning to parents to check what their children are doing online as they could face financial penalties if their children access illegal material. IFPI and its affiliate national bodies have announced nearly 2,000 new legal cases against individuals uploading large amounts of copyrighted music and are extending actions to Portugal, where the legal market has been devastated by the impact of illegal file-sharing. In Italy a series of raids against individual file-sharers and servers in the past fortnight has led to the seizure of more than 70 computers in the search for evidence.  In the UK the British Phonographic Institute (BPI) has estimated that illegal file sharers have cost the UK music market £1 billion over the last three years.  Research from the IFPI indicates that the deterrent provided by legal action has been enough to dissuade one in five file sharers from continuing with illegal practices. The IFPI chairman , John Kennedy, warned: 'People who file-share illegally often claim to be music fans but in fact they are hurting investment in music, breaking the law and risking financial penalties by their actions.' The IFPI are seeking to increase awareness of the perils of illegal downloading, announcing that outside of the US there have been 5,500 prosecutions with an average settlement of 2,633 euros (£1,834). These actions, a combination of criminal and civil suits, are aimed at ‘uploaders’ – people who have put hundreds or thousands of copyrighted songs on to internet file-sharing networks and offered them to millions of people worldwide without permission from the copyright owners.  The defendants are likely to face compensation payments averaging several thousand euros. Today’s actions target users of all the major unauthorised p2p networks, including FastTrack (Kazaa), Gnutella (BearShare), eDonkey, DirectConnect, BitTorrent, Limewire, WinMX, and SoulSeek in Austria, Denmark, Finland, Germany, Hong Kong SAR, Iceland, Italy, Portugal, Sweden and Switzerland

AS SPITZER SETTLES WITH LABELS, THE FCC TALKS TO RADION STATIONS IN PAYOLA SCANDAL 03/04/06
Four of the USA's largest radio station groups are in active talks with the Federal Communications Commission to settle investigations over alleged pay-for-play violations. negotiations with Clear Channel Communications, CBS Radio, Entercom Communications and Citadel Broadcasting began in February but are allegedly bogged down over how large a fine the companies should pay and what constitutes improper on-air promotions. Another disagreement apparently centres on the FCC's contention that the practice of giving radio stations CDs, concert tickets and other goods in exchange for mentioning upcoming concerts and album releases violates federal regulations unless stations disclose the deals to listeners. Many industry comentators say that this is standard and would be impossible to regulate. Under federal law, it is illegal for a radio station to accept anything of value in exchange for airplay unless listeners are told. New York Attorney General Eliot Spitzer has already settled with Warners and SonyBMG in his ongoing enquirey into payloa.

After strong growth in the past few years, music DVDs slipped for the first time (by 4%). RIAA figures from the USA  figures show that CD shipments were down 8% to 705M units. The US, Japan, the UK, Germany and France are the main digital markets whilst South Korea is now the eighth biggest digital market last year (despite low physical sales). Digital makes up 5% of value globally; 'A la carte' accounts for 44% of digital sales, mobile hold 49% and subscription has 7%; And - Coldplay had the biggest-selling album (X&Y) of the year (with sales of 8.3M).
