It is understood at the time of writing that the US Court of Appeals Sixth Circuit is to review its decision. This three judge panel held that whilst a de-minimis test (substantial use) might apply to the use of a song (the musical and lyrical copyrights) the use of any part of a sound recording without permission would be an infringement of copyright.
